Boarding and Doggie Day Care 'PLAY' Contract Agreement

This is a contract between Dog Paws Boarding Resort, LLC. (Hereinafter referred to as the “Kennel”) and the pet owner whose electronic signature appears at the bottom of this document (Hereinafter referred to as the “Owner”). 

1.  The Kennel agrees to exercise due and reasonable care to keep its premises clean and sanitary and properly enclosed in accordance with Iowa State Law.

2.  Owner agrees to have dog in secure quick release collar (or harness) with name tag when entering or leaving facility.  If a quick release collar is not on dog, one will be provided by Kennel and Owner will be charged and agrees to pay for said collar.*
3. Owner agrees to complete all required forms Boarding Intake Application form, Boarding Contract, Veterinary Liability and Release Form and send End-of-Life Care email.  New client tours are required prior to stay at Kennel, exceptions maybe arranged depending on if stay is an emergency and tour is not able to be completed prior to check in.*
4. Fees: Owner shall pay the rate for boarding that is in effect on the date the animal(s) are checked into Kennel. Owner agrees that the animal(s) shall not leave the Kennel until all charges are paid in full by Owner. All payments (other than deposits or cancellation charges) are due at the time you come to pick up your animal(s). Owner gives permission to Kennel to charge any credit card provided by Owner for unpaid services, products, deposits, cancellation fees or products upon the time services were to have been paid. Charges of services plus 3% surcharge for debit/credit transactions will apply for all services offered, will not be charged surcharge fee if paying via check or cash.  Owner further agrees to pay all collection costs and any costs associated with returned checks or debit/credit charges.  All pricing and policies are subject to change without notice.*

5. Charges: Owner agrees to all of the following charges that may apply to stay.  Charges (other than non-refundable deposits) will appear on final invoice if applicable. All pricing and policies are subject to change without notice.

-Puppies Boarding $75/day (up to age 4 months or under vaccinated).
-Unaltered Males or Females per $75/day + Cleaning fees.
-Safe Care Handling fee for Non-social or Aggressive Dogs is $30/day.
-Quarantine Boarding $90/day
-PLAY and Pawstime added to boarding will be $18/day/dog. Special discount provided for Multi-pets.
-A 50% non-refundable deposit for the length of stay is required to confirm reservations during Holidays (Memorial Day, Independence Day, Labor Day, Thanksgiving, Christmas, New Year's and Cedar Rapids Spring Break).
-Multi-pet stays will require a non-refundable deposit equivalent to half the entire length of stay.
-Single pet stays over 5 days will require a non-refundable deposit equivalent to half your total length of stay.
-A Late Fee of $30 will be applied to the final invoice for late check ins or pick ups.
-Extra cleaning care fee may apply for incontinence etc.  This charge would be applied to your final invoice as needed.
-Convenience Supply Run fee of $18/trip will be applied to your final invoice as needed if your kiddo runs out of food or something special during their stay.

6.  Kennel has the right to refuse service at any time with regard to any services offered by Kennel for any reason whatsoever in the Kennel’s sole and absolute discretion.*
7. The Owner of the within named animal(s) specifically represents that he/she is the sole owner of said animal(s) and that there is not now any lien or mortgage against said animal(s) and that the within named animal(s) has not been exposed to distemper or rabies within the last 30 (thirty) days, and that any required annual licenses has been obtained.*
8. The Kennel is State Licensed and is required to take adequate measures to provide for disease control. In an effort to comply with this law and to provide a healthy and safe environment for all animal(s) under Kennel care, the Kennel requires the following: a. The following immunizations must be up to date: i. Dogs require age appropriate vaccines which include: Distemper, Rabies, and Bordetella (annually) and a negative fecal exam (30 days prior to initial boarding stay then annually)  b. If animal(s) are found to have fleas/ticks, Kennel will administer treatment at Owner expense (including fees for flea/tick bath treatment for animal(s) and treatment of Kennel building and boarding areas.) c. Owner understands and acknowledges that although Kennel requires animals to have current vaccinations, this does not guarantee against illness or disease. d. Owner understands and acknowledges that pet must wear collar with valid rabies vaccination tag attached to the collar when off the Owner’s premises. e. Owner understands and acknowledges that puppies under 4 months old may be boarded, participate in Doggie Day Care PLAY or Pawstime but are at risk due to not being fully vaccinated, Owner accepts all risk and treatment costs if puppy becomes sick during these activities or boarding.*
9. Veterinarian Care and Liability: Owner agrees to all conditions as noted on the Veterinary Liability and Release Form. Owner understands and acknowledges that if animal becomes ill or injured, the Kennel will attempt to notify Owner or Emergency contact individual listed on Boarding Intake Application Form once. If Owner or Emergency contact individual does not immediately inform the Kennel regarding measures to be taken or if the state of the animal requires immediate action, the right to initiate a Veterinary consult, onsite Veterinary visit, to administer medicine or to give advisable attention is at the discretion of the Kennel,and the Kennel shall be held harmless by any and all parties, including but not limited to Owner or any parties related to or affiliated with Owner, whether the Kennel attempts to seek any type of Veterinary or other animal care or elects not to seek such care.  Moreover, the Kennel shall be held harmless by any and all parties, including but not limited to Owner or any parties related to or affiliated with Owner, if the animal requires Veterinary care, a Veterinary consult, a Veterinary visit, and/or medication but such Veterinary (or veterinary pharmacy) services are unavailable within 75 road miles of the Kennel’s location.  Furthermore, Owner shall be billed directly for any Veterinary, animal care, or veterinary pharmacy services required by animal, or shall reimburse the Kennel for any such services which are charged directly to the Kennel, and Owner shall reimburse the Kennel’s road mileage for transporting the animal to and/or from any Veterinary facility, to include all mileage incurred between the Kennel and the Veterinary facility due to follow-up visits or if an animal must be dropped off at (and later picked up from) the Veterinary clinic or animal’s prescription (or over-the-counter medication or treatment) must be picked up from the veterinary pharmacy.  *
10. Medication Administration: Owner authorizes Kennel to administer over the counter or prescription medications to your animal(s) as listed in the Boarding Intake Application Form. A Medication Administration fee may apply.  Loose stools are typical in boarding situations which are stressful on animals. If animal develops diarrhea it will be monitored and treated initially by removing food/treats and/or providing over the counter anti-diarrhea medication at Kennel’s discretion. If diarrhea continues despite these efforts, a Veterinarian will be called. Owner will not be notified if temporary and improves.*
11. The animal(s) listed on the Boarding Intake Application Form is not to be taken off the premises without the consent of the Owner, unless Kennel is taking animal(s) to receive Veterinary care.*
12. Abandoned Animals: No Animal(s) may be left at Kennel after the scheduled pick up time without communication from Owner. If your animal(s) is left at Kennel without any contact, instruction or notification regarding its pick up from Owner or your authorized representative, your Animal(s) will be deemed “Abandoned” at 7 P.M. on the seventh (7th) day after the scheduled pick up date. The Owner will be sent a certified letter to the last known address of the owner regarding this abandonment. For fourteen (14) days after the mailing of the notice the owner shall have the right to reclaim the animal upon payment of all reasonable charges, and after the fourteen days the owner shall be deemed to have waived the rights to the abandoned animal, and the Kennel will become its legal owner and guardian. The Kennel will, in its sole discretion, determine whether to re-home the animal(s), relinquish animal(s) to a shelter/rescue or humanely destroy the abandoned animal(s). OWNER FULLY UNDERSTANDS AND AGREES THAT IF YOU ABANDON YOUR ANIMAL AT KENNEL, YOU MAY BE UNABLE TO RETRIEVE POSSESSION OF YOUR ANIMAL(S) AND WILL HAVE NO RECOURSE AGAINST KENNEL.*
13. Photo and Marketing Release: Owner agrees that Kennel or training classes provided by third-party training service providers  may use photographs of me and my animal(s) with or without my name and for any reason/purpose including but not limited to: lawful purposes as publicity, illustration, advertising, web content, or social media websites. Owner understands and acknowledges no payments from Kennel to Owner will be exchanged for Photos used as noted above.*
14. Cancellation Policy: Owner understands and acknowledges that any cancellation of scheduled services by the Client within 24 hours of the scheduled service may incur charges as determined by Dog Paws Boarding Resort, LLC. 

-Cancellations of 24 hours or less in advance may be charged 1/2 your total length of stay.

-Cancellation fee will apply after reservation confirmation has been sent through Pocketsuite.  Cancellation invoice will be 50% of the entire length of stay.

15. Reservation Guidelines: Owner understands and acknowledges that to confirm a reservation a credit card will be required to be on file.  Owner may still pay via check or cash at time of checkout to avoid surcharges.  A non-refundable deposit equal to ½ your total length of stay will be required for reservations longer than 5 days.  A 50% non-refundable deposit for the length of the stay is required to confirm reservation during Holidays (Memorial Day, Independence Day, Labor Day, Thanksgiving, Christmas, New Year’s and Cedar Rapids Spring Break). Multi-pet stays will require a non-refundable deposit equivalent to half the entire length of stay.   All pricing and policies are subject to change without notice.*
16. Personal Property: The Kennel is not responsible for damage or loss of any items brought into the Kennel by Owners such as, but not limited to: bedding, toys, chews, food, collars, leads or medication. Items given to animal(s) in boarding units will be removed at the sole discretion of the Kennel. All bedding material brought by Owner to Kennel must be freshly washed (and free of stuffing materials).*
17. Boarding Units: The Kennel reserves the right to move animal(s) from one boarding unit to another (such as another boarding inside kennel, crate or outdoor kennel) at its sole discretion and without notice to Owner.*
18. Dog Paws Doggie Day Care 'PLAY':  Kennel provides Doggie Day Care 'PLAY' services to those Boarding at Dog Paws.  Owner understands and acknowledges that the Kennel has relied on Owners representation that their dog is in good health and has not been ill with any communicable disease within the last 30 days.  Owner understands and acknowledges that Dog will undergo aptitude test administered by Kennel prior to participation in Doggie Day Care 'PLAY' and Kennel has sole judgement and discretion in participation in said Doggie Day Care 'PLAY'.  Owner further understands and acknowledges all of the following: a. Dog has not harmed or shown aggressive or threatening behavior towards any person or any other dog. b. Owner is solely responsible for any harm caused by their dog (pets or persons) while it is attending Doggie Day Care 'PLAY' or any other social/training activities. c. The Kennel will not be held responsible for any problems that develop, provided reasonable care and precautions are followed, and Owner hereby releases the Kennel of any liability of any kind whatsoever arising from their dog’s attendance in Doggie Day Care 'PLAY' or other social/training activities. d. Owner understands and acknowledges that any problem that may develop with their dog will be treated as deemed best by Kennel, in their sole discretion, and Owner assumes full financial responsibility for any and all expenses involved. e. Owner’s dog is always on probation and can be excused from the Doggie Day Care 'PLAY' or other social/training activities at any time within the sole discretion of the Kennel. f. 10 day and 20 day packages for Doggie Day Care 'PLAY' will expire 6 months from date of purchase. g. No refunds will be given for Doggie Day Care 'PLAY' purchases.  h. Late charges of $30 will be charged to Owner if dog isn't picked up during designated times. i. Dog Paws Pawstime is for those dogs who have aged out of PLAY or want specialized 1:1 attention.
19. Kennel Cough:  Owner understands and acknowledges that if your dog is showing any symptoms of illness please they will not be able to Board, PLAY or Pawstime until they recover and have been treated by your veterinarian.  Dog Paws does not allow any Boarders, PLAY or Pawtime members to attend who have had Kennel Cough to return to Dog Paws until 10 days after their symptoms have stopped.  Dog Paws will not pay for the treatment of Kennel Cough or refund charges from a stay.*
20. Litigation: Should there be a dispute or litigation over this document or any other document signed with Kennel, the prevailing party shall be entitled to their reasonable attorney’s fees and costs. Any litigation shall take place in Linn County, IA.*
21. Waiver, Release and Indemnification: Owner acknowledges this paper format with the understanding that it will be filed electronically. Owner acknowledges that an electronic waiver is as binding in all causes as a paper format. Owner agrees that if any portion of this agreement is held to be invalid or unenforceable, that the remainder of this agreement will remain in full force and effect.

The Kennel does not assume and shall not be held responsible for any liability with respect to any and all animal(s) listed in the Boarding Intake Form Agreement, of any kind, character, or nature whatsoever, arising out of or from the boarding of this/these animal(s), Doggie Day Care 'PLAY', Pawstime or any damages which may accrue from any other cause whatsoever, including but not limited to loss, damage,  illness, or injury arising from or otherwise related to fire, theft, escape, death, animal recreational activities (including, but not limited to, training classes provided by third-party training service providers), transportation of animal or other animals, injury to persons, injury to animal or other animals, damage to property, or death, illness, or injury to any other animal caused by (or caused to) the within named animal(s) during the term of this contract, whether this animal(s) be on the premises of the Kennel or not, explicitly including – but not exclusively including – those liability limitations within Section 9, above. The Owner of said animal agrees hereby to be, and is solely responsible for, any and all acts of behavior of said animal at any time within the term and time of this contract, and in no case shall the Kennel be in any way liable or responsible for the acts and/or behavior of said animal. Owner agrees to indemnify and hold harmless Kennel for any and all damages to the premises, equipment, employees, other clients and other dogs which is caused by Owner or Owner’s animal. Owner further agrees to pay all costs and expenses incurred for such damage and injury.  *

OWNER UNDERSTANDS AND ACKNOWLEDGES THAT BY SIGNING THIS DOCUMENT ELECTRONICALLY IT WILL CARRY THE SAME LEGAL FORCE AND BINDING AS A HANDWRITTEN SIGNATURE.
