TERMS & CONDITIONS OF MEMBERSHIP ACKNOWLEDGEMENT AGREEMENT 1. Statement: You agree to abide by the bylaws, policies, and rules of the Greater San Diego Association of REALTORS® (SDAR) as they apply to the category of membership for which you are applying, and as may be amended from time to time, as well as the REALTOR® Code of Ethics. You understand that you must attend an Orientation within sixty (60) days of applying for REALTOR® membership. Failure to do so could result in the termination of all MLS privileges and fees forfeited. 2. Authorization/Acknowledgement: a. Term: Greater San Diego Association of REALTORS® membership renews annually, unless written cancelation is provided by member 30 days prior to next billing date. All SDAR members are continuously enrolled in membership until they opt-out of the membership agreement. The terms and conditions of this membership are acknowledged by receipt of this Terms & Conditions Agreement. Member acknowledges personal responsibility for any change, alteration, or cancellation of membership agreement via written notification due thirty (30) days prior to next billing date. b. Dues/Subscriptions/Fees: i. Auto debit enrollment: Your enrollment in the auto-debit program acknowledges that you authorize the Greater San Diego Association of REALTORS® to automatically deduct your payment for dues, services, and/or San Diego MLS subscriptions from the debit card or credit card you provided on your account. Further, your member dues may increase from time to time, and these may also be processed with your enrollment in our auto-debit program. Auto payments will be processed prior to the quarterly billing dates: first week of January, April, July, and October. ii. Cancellation: Members who wish to cancel their membership agreement, are required to submit their request for cancellation via written notice. Cancellation requests must be received by SDAR thirty (30) days prior to the upcoming billing period. Quarterly billing dates are the first week of January, April, July, and October. iii. Non-refundable: You understand that your REALTOR® membership dues are non-refundable. In the event that you fail to maintain eligibility for membership for any reason, you understand that you will not be entitled to a refund of any dues or fees. SDAR will not refund any MLS fees, dues, or services paid under this Agreement. All fees are non-refundable, due to the services and benefits provided to members. If you cancel or terminate your membership or move your primary membership to another Association at any time prior to the end of the calendar year, the entire amount of your annual dues become immediately due and payable and you authorize SDAR to immediately charge the entire amount to your credit card on file before cancelling this authorization. iv. Opt-out: This enrollment agreement will remain active and in force until we receive a written cancellation from you. Auto-debits will begin on the first of the month following receipt of this authorization form. In order to opt-out of auto-debit authorization, a written cancellation request notification from the member, must be received by SDAR thirty (30) calendar days prior to the next payment billing date. Quarterly billing dates are the first week of January, April, July, and October. 3. Permission to Communication (opt in to email and association/SDMLS communications): I expressly authorize the Association, including the State and National associations and San Diego’s regional MLS to email, telephone, fax, or send by mail any material advertising benefits, dues, courses, notices, and goods and services offered, endorsed, or promoted by the Association. Withholding consent will affect your ability to receive other communications pertaining to your Association Membership. Please be advised that SDAR does not sell or rent the e-mail address of its members to any other organization. 4. Maintain Good Standing: I agree to maintain good standing, with no record of official sanctions rendered by the courts or other lawful authorities for (i) violations for civil rights laws or real estate license laws within the past three years or (ii) criminal convictions if (1) the crime was punishable by death or imprisonment in excess of one year under the law under which the applicant was convicted and (2) no more than ten years have elapsed since the date of the conviction or the release of the applicant from the confinement imposed for that conviction, whichever is the later date.” SDAR Bylaws Article V: Section 2.C. 5. Arbitration: I agree that as a member of SDAR as a REALTOR® and a subscriber of San Diego MLS, I also agree to binding arbitrations of disputes. As a REALTOR® including Designated REALTOR®, or REALTOR® Association member, you agree for yourself and the corporation or firm for which you act as a partner, officer, principal, or branch office manager to binding arbitration of disputes with (i) other REALTORS® or REALTOR® Associate members of this Association; (ii) with any member of the California or National Association of REALTORS® and (iii) any client provided the client agrees to binding arbitration at the Association.
