THE WAIVER AND RELEASE FORM

RELEASE OF LIABILITY

In return for being allowed to participate in BALLET FOLKLORICO XOCHIPILLI, INC dancer activities and all related activities, including any activities incidental to such participation, the under-signed dancer or Parent/Legal Guardian of Volunteer if Volunteer is under age 18 (hereafter referred to using “I”, “me”, or “my”) releases and agrees not to sue the BALLET FOLKLORICO XOCHIPILLI, INC or its officers, directors, employees, sub-contractors, sponsors, agents and affiliates from all present and future claims that may be made by me, my family, estate, heirs, or assigns for property dam- age, personal injury, or wrongful death arising as a result of my participation in the Volunteer Activities wherever, whenever, or however the same may occur.

I understand and agree that the BALLET FOLKLORICO XOCHIPILLI, INC are not responsible for any injury or property damage arising out of the Volunteer Activities, even if caused by their ordinary negligence or otherwise.

I also agree to indemnify and hold harmless the BALLET FOLKLORICO XOCHIPILLI, INC for all claims arising out of my participation in the Volunteer Activities.
I understand that this document is intended to be as broad and inclusive as permitted by the laws of the state in which the dancer activities take place and agree that if any portion of this Agreement is invalid, the remainder will continue in full legal force and effect.

I also acknowledge that the BALLET FOLKLORICO XOCHIPILLI, INC have not arranged and do not carry any insurance of any kind for my benefit or that of dancer (if dancer is under 18), my parents, guardians, trustees, heirs, executors, administrators, successors and assigns. I represent that, to my knowledge, I am in good health and suffer no physical impairment that would or should prevent my participation in Dancer Activities.

I also understand that this document is a contract which grants certain rights to and eliminates the liability of the BALLET FOLKLORICO XOCHIPILLI, INC.

PUBLICITY RELEASE

In return for being allowed to participate in Ballet Folklorico Xochipilli, Inc. dancer activities and all related activities, including any activities incidental to such participation, the undersigned Dancer or Parent/Legal Guardian of dancer, if Dancer is under age 18 (hereafter referred to using “I”, “me”, or “my”) hereby grants to the Incorporation, and each of its subsidiaries, affiliates, agents, advertising or promotional agencies, and partners, and all such entities’ officers, directors, agents, employees, respective successors and assigns (collectively, “Authorized Parties”), the absolute and irrevocable right and permission to use, publish, broadcast and/or copyright the use of Dancer’s name, address, voice, photograph and/or like- ness, caricature, and personal information, in its current form or as retouched, digitized, cropped, altered, distorted or modified in any way, in any and all advertising, promotional, or other mate- rials based upon or derived from the Dancer activities in any manner, in any media whatso- ever for any and all purposes, including by way of example but without limitation advertising, promoting or publicizing products and services throughout the universe, in perpetuity, in any and all media now known or hereafter devised (including without limitation on the Internet), without additional compensation. I further agree that anything derived therefrom will be owned solely by the Authorized Parties. I shall not authorize the use of any print, negative or other copy thereof by anyone other than the authorized parties.

I understand that this document is intended to be as broad and inclusive as permitted by the laws of the state in which the dancer Activities take place and agree that if any portion of this Agreement is invalid, the remainder will continue in full legal force and effect.

Costume Agreement

⦁ Costume Use: Dance Group shall provide Dancer with costumes for dance performances and rehearsals. Dancer agrees to use the costumes solely for dance performances and rehearsals approved by Dance Group. Dancer shall take good care of the costumes and shall not use them for any other purpose.
⦁ Costume Care: Dancer shall be responsible for the care of the costumes. This includes, but is not limited to, hanging costumes up properly, keeping them clean, and making sure they are returned to Dance Group after each use in good condition. If any costumes are damaged or lost, Dancer shall be responsible for the replacement or repair cost.
⦁ Damages or Losses: Dancer/Parent/Guardian shall be responsible for any damages or losses that occur to the costumes during Dancer's use. This includes any damage or loss caused by Dancer's negligence, carelessness, or misuse. In such cases, Dancer/Parent/Guardian shall pay Dance Group the cost of repairing or replacing the costume.
⦁ Indemnification: Dancer/Parent/Guardian shall indemnify and hold harmless Dance Group, its directors, officers, employees, and agents, from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with any damage or loss to the costumes caused by Dancer/Parent/Guardian's negligence, carelessness, or misuse.
⦁ Ballet Folklorico Xochipilli, Inc is not responsible for any loss or damages while they are in possession of the dancer (if under age of 18 of Parent/Legal Guardian). Whomever is in position of the costume is responsible for it until returned back to Ballet Folklorico Xochipilli, Inc.
