Pawsitively Perfect Pup Cruise Liability Waiver

*All PERSONS BOARDING THE PUP CRUISE must complete the waiver below. Failure to do so will result in denied entry.*

I understand that my attendance at Circle Line's Pup Cruise (hereinafter referred to as the “Event”) is not without risk to myself, my pet, other attendees (human or dog), and the employees of New York Cruise Lines, Inc. (hereinafter referred to as “NYCL”).  These include, without limitation, risks of physical injury, mental injury, emotional distress, trauma, death, contact with other participants and their dogs, and property damage.  All risks are known and appreciated by me.  I waive any and all specific notice of the existence of the risks.  I shall assume responsibility for and pay my and my dog’s medical and emergency expenses in the event of injury, illness, or other incapacity regardless of whether I authorized such expenses.  I agree that I, as owner of the above dog(s), am solely responsible for the dog’s behavior and physical control and agree to carefully monitor and control it at all times.

By reading, signing and dating this document, I hereby waive and release NYCL and its subsidiaries, affiliates, partners, employees, officers, agents, owners of any or all premises on which this event is held, and other related parties (collectively referred to herein as “NYCL and its affiliated parties”), from any and all damages, losses, fines, claims, suits, expenses (including attorney fees and defense costs), judgments and/or liabilities of any form or nature resulting from any act or omission of any dog or dog owner participating in the Event.  This release of liability includes, but is not limited to, any injury, death, sickness or personal injury or property damage my dog or I may suffer while on or around the premises where the Event is held.  This release also includes specifically, but without limitation, any and all forms of personal injury (including death) and property damage to myself, other persons, and other dogs resulting from the act or omissions of any and all dogs or dog owners and I expressly assume the risk of such damages or injuries and losses throughout the duration of the Event.

I also agree to defend, indemnify and hold harmless NYCL and its affiliated parties from any and all claims, suits, losses, damages, expenses (including attorney fees and defense costs), judgments, fines, penalties and/or liabilities, due to any and all forms of personal injury (including death) and property damage which my dog or I may cause, or be alleged to have caused, to any person, dog, or property while on or around the premises where the Event is held, or in connection with the instruction provided by NYCL and its affiliated parties.

In consideration for NYCL’s services and use of NYCL’s facilities, I agree to abide by the terms and conditions of this Agreement. 

• I agree to NOT bring a dog onto NYCL premises if I reasonably believe the dog might cause injury to other dogs or to humans.
• I agree NOT to bring a dog with a known propensity to act viciously onto NYCL premises, whether I have actual or constructive knowledge of the danger presented by the dog.
• If any dog I own (or under my control) threatens harm to any person or animal, I must take immediate action to minimize the harm presented by any such dog.
• All dogs must be leashed and under owner’s control at all times.
• I agree to follow NYCL’s instructions and conform with all rules (whether written or verbal) provided by NYCL before, during and after the Event.
• NYCL can refuse boarding if I do not meet my responsibilities as an attendee of the Event.
• Owners will be required to clean up after their dogs.

If attendee is under the age of 18, the parent or legal Guardian must e-sign below.
