DRP request for assistance

As a global participant in the Disaster Response Program, Esri Australia supports organisations working in disasters and emergencies as part of our corporate citizenship.

Due to the nature of this support, we request participants read and accept the terms outlined below. Once you submit, you will be redirected to a DRP request form.

Waiver and indemnity from third party claims

This agreement is between Esri-Australia Pty Ltd (‘Esri Australia’) and You (together, ‘the parties’) and is pursuant to the exchange of promises between the parties.

1.     By accessing these services, You confirm that You waive any right to any and all claims, liabilities, obligations, promises, agreements, disputes, demands, damages, causes of action of any nature and kind which You have or ever had or may in the future have against Esri or any of its officers, employees, agents or contractors arising out of or relating to the services and/or products provided to You by Esri Australia.

2.     ‘Services and/or products’ includes (but is not limited to) any professional, advisory, training and/or managed services to be performed by Esri Australia, any software licences and any other specifications for Services and/or deliverables that are provided by Esri Australia.

3.     Esri Australia makes no representation and gives no warranty about the accuracy, reliability, completeness or suitability for any particular purpose of the information provided to You. You should not rely on information shown to make any decision with financial or legal implications and should instead rely on your own enquiries.

Liability

4.     To the full extent that it is able to do so at law, Esri Australia is exempt from all liability (including liability in negligence) for all costs, losses and damages (costs) (including indirect and consequential costs) caused by or arising from anyone using or relying on the information shown in any product provided to you by Esri Australia for any purpose whatsoever.

Indemnity

5.     You indemnify and hold harmless Esri Australia and each of Esri Australia’s officers, employees and agents (those indemnified) from and against any loss, costs, expenses (including legal costs and expenses on a solicitor and own client basis) or liability incurred or suffered by any of those indemnified arising from any action, claim or proceedings against those indemnified, including by third parties, whether caused by the fault of those indemnified or otherwise.

Termination

6.     Esri Australia may, at any time, with no reason required, terminate the provision of the services and/or products with no obligation or liability to You.

Survival

7.     The terms of this waiver shall survive the completion of the services and/or delivery of products.

General

8.     This waiver shall be binding upon the parties. The terms of this waiver shall be governed by and construed in accordance with the laws of the State of Queensland.
